Terms of Service

These Terms of Service ("Terms") govern your use of the Captive iOS application ("the App"), developed by Gordan Valenta ("we", "us", "our"). By downloading or using the App, you agree to these Terms.

1. Description of Service

Captive is an AI-powered caption generation tool for social media content creators. The App generates caption suggestions based on topics you provide. These captions are AI-generated and intended as starting points — always review before publishing.

2. User Accounts

• The App creates an anonymous account automatically on first launch. You may optionally register with email, Google, or Apple Sign-In.
• You are responsible for maintaining the security of your account and for all activity under it.
• You must be at least 13 years old to use the App.

3. Subscriptions and Billing

• Free tier: 10 caption sets on Day 1 (welcome bonus), then 2 sets per day.
• Premium tier: Unlimited caption sets, additional tones, full history, and hashtag generation.
• Premium subscriptions are offered on a monthly or annual basis and are managed through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your Apple ID account settings.
• No refunds are provided for partial subscription periods, except where required by applicable law.

4. AI-Generated Content

• You retain ownership of the topics you provide. You are granted a non-exclusive, royalty-free licence to use captions generated from your topics.
• Do not submit topics that include personal data of others, confidential information, or content that is illegal or harmful.

5. Acceptable Use

You agree not to use the App to:

• Generate content that is illegal, defamatory, harassing, or infringes on the rights of others
• Attempt to reverse-engineer, scrape, or abuse the AI generation service
• Circumvent usage limits through automated means or multiple accounts
• Use the App in any way that violates applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

The App, its design, code, and branding are owned by Gordan Valenta and protected by copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works of the App without our prior written consent.

7. Disclaimers and Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free from harmful components.

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or business opportunities, arising from your use of the App.

8. Changes to the App and Terms

We may modify or discontinue features of the App at any time. We may also update these Terms. We will update the "Last updated" date above and notify you through the App for material changes. Continued use after changes constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of the Republic of Croatia, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Croatia.
